Terms of Service

Last updated October 9, 2026

1. Agreement and eligibility

These Terms of Service ("Terms") are a binding agreement between you and [LEGAL ENTITY NAME, e.g. PK Eats LLC], a [STATE] limited liability company ("PK Eats," "we," "us"). They cover the website at pkeats.com, the PK Eats Discord server, and any related services (the "Service").

You accept these Terms by checking the box or clicking "I agree" when you create an account or place your first order. If you do not agree, do not use the Service.

Please read Section 10 carefully. It requires most disputes to be resolved by individual arbitration and waives class actions, unless you opt out within 30 days.

You must be at least 18 years old to create an account, add funds, or place orders. If you are between 13 and 17, you may use the Service only with a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use, including all deposits and orders. The Service is not for anyone under 13.

2. What PK Eats is, and is not

PK Eats is an independent ordering service. When you place an order, we act as your agent and place it with a third-party restaurant or delivery provider (a "Merchant") using the details you give us.

3. Your account

You sign in with Google or Discord. You are responsible for keeping that account secure and for all activity under your PK Eats account. One person per account; accounts cannot be shared, sold, or transferred.

Tell us right away at pkeats9@gmail.com if you think someone has accessed your account without permission. We are not responsible for losses caused by your failure to secure your Google or Discord account, but we will investigate any reported unauthorized use in good faith.

4. Your PK Eats balance

Your balance is a prepaid amount you can spend on orders. Deposited money remains yours and you can get it back on request; promotional credits work differently.

5. Orders, prices, and fees

Before you pay, checkout shows an itemized total: menu prices, taxes, delivery fees, any PK Eats service fee, and tip. Your balance is charged only when you confirm, and an unpaid checkout expires after 15 minutes.

6. Food, allergens, and delivery

We pass along menu and allergen information from Merchants but cannot verify it, so contact the Merchant directly about any allergy before ordering.

7. Refunds and order problems

Report a problem within 48 hours of your order and we will try to get it fixed or refunded.

  1. Email pkeats9@gmail.com or post in the PK Eats Discord server with your order number, what went wrong, and photos if relevant.
  2. We will pass the issue to the Merchant and request a refund or replacement on your behalf.
  3. Refunds we obtain, or choose to give, are credited to your balance by default. You may ask for refunds of deposited funds to be returned to your original payment method under Section 4.

We decide goodwill credits case by case. Nothing in these Terms limits any refund right you have under law.

8. Acceptable use and suspension

You may not misuse the Service. In particular, you may not:

We may suspend or close accounts that break these rules. We will usually tell you why and give you a chance to respond, unless that would risk fraud or harm. If we close your account, Section 4 governs your remaining balance.

9. Disclaimers, limitation of liability, and indemnity

Disclaimer. The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted or error-free, or that any Merchant will accept or fulfill an order.

Limitation of liability. To the fullest extent the law allows:

These limits do not apply to liability that cannot be limited by law, such as for our gross negligence, fraud, or willful misconduct, and do not reduce your right to withdraw your deposited balance.

Indemnity. You agree to cover our reasonable losses and costs, including legal fees, from claims by third parties arising from your breach of these Terms or your misuse of the Service.

10. Resolving disputes

Most disputes go first to informal talks, then to individual arbitration, not court or class actions.

11. Changes, termination, and contact
